1. Booking and Deposit
A booking is confirmed only when Aurora has received both your signed booking form and the successful £200 deposit payment.
The £200 deposit secures your date in Aurora’s diary. It is non-refundable where you cancel the booking or where Aurora is entitled to end the contract because of your material breach of these terms. The deposit will be deducted from your final balance.
2. Cancellation by You
Aurora accepts a limited number of bookings each year. When a date is reserved, Aurora may turn away other work. The cancellation amounts below are intended to be a reasonable estimate of Aurora’s loss if the booking is cancelled and the date cannot be rebooked. They are not intended to be a penalty.
The total cancellation amount due is:
- 9–12 calendar months before the event: £700.
- 6–9 calendar months before the event: 50% of the total booking fee.
- 3–6 calendar months before the event: 75% of the total booking fee.
- 1–3 calendar months before the event: 85% of the total booking fee.
- Within 1 calendar month of the event: 100% of the total booking fee.
Any deposit already paid counts towards the total cancellation amount due. Aurora will take reasonable steps to reduce its loss, including seeking to rebook the date where practical. If the date is rebooked for equivalent work, this will be taken into account so that you are not charged more than Aurora’s actual loss.
To cancel, email auroraweddingband@gmail.com. Cancellation takes effect when Aurora acknowledges your email in writing. If you do not receive an acknowledgement, please make further reasonable efforts to contact Aurora by WhatsApp or telephone. Cancellation payments must be made by bank transfer within 28 days of cancellation.
3. Moving Your Event Date
One change of date may be made without charge, subject to Aurora being available on the new date and no conflicting booking being in place. Any further change of date will incur a £200 administration charge.
If Aurora is unavailable on the proposed new date, you may keep the original date or cancel the booking under section 2. If you move your date and later cancel, the cancellation period will be calculated using the original event date, unless the new event date is sooner.
4. Performance Times, Access and Delays
Aurora will perform during the times stated in your booking form. Standard booking times are 20:00–00:00 unless otherwise agreed in writing.
Please allow at least 45 minutes for Aurora to set up. Aurora will normally aim to arrive around 40 minutes before the scheduled start time, unless access arrangements require otherwise.
You must tell Aurora in advance about any restricted, difficult or unusual access, including stairs, long distances from parking, loading restrictions or limited set-up time. Aurora is not responsible for delay or reduced performance time caused by late access, inaccurate access information, venue restrictions or circumstances outside Aurora’s reasonable control.
5. Payment
The remaining balance is due by bank transfer in the month before your event. Aurora will contact you with current bank details and the payment due date.
Other than where these terms say otherwise, payments are non-refundable only to the extent Aurora is legally entitled to retain them. Nothing in these terms affects any rights you may have by law.
6. Your Responsibilities and Aurora’s Right to End the Contract
Aurora may end the contract where you materially breach these terms, including by failing to make a required payment, providing materially inaccurate event or access information, creating unsafe or illegal conditions, or engaging in abusive or threatening conduct.
Where practical and safe, Aurora will give you a reasonable opportunity to remedy the breach. Aurora may end the contract immediately where there is a genuine safety, legal or serious conduct concern.
If Aurora ends the contract because of your material breach, Aurora may retain or recover only its reasonable, direct loss resulting from that breach, taking account of any amount already paid.
7. Damage to Equipment
Only Aurora’s members may use or operate Aurora’s equipment, including instruments, sound and lighting equipment. You are responsible for reasonable repair, replacement or hire costs, and any demonstrable direct loss, where equipment is damaged or stolen by you or your guests, except where Aurora is responsible.
Aurora will notify you as soon as reasonably practical and provide details of the costs. Any invoice is payable within 28 days.
8. Breaks
Aurora normally takes a break of around 45 minutes to coincide with the evening buffet. For bookings that run past midnight, Aurora may also take a short comfort break.
9. Insurance and Liability
Aurora maintains public liability insurance appropriate for live performances. Details are available on request. Public liability insurance may respond to certain claims for injury or property damage where Aurora is legally liable, subject to the policy’s terms, conditions and exclusions. It does not remove Aurora’s legal responsibilities or guarantee that every type of claim is covered.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that, Aurora’s total liability in connection with the booking will not exceed the total amount paid under the booking contract.
10. In the Extremely Unlikely Event That Aurora Cannot Perform
Aurora has never missed a performance. In the extremely unlikely event that we are unable to perform as agreed, we will contact you as soon as possible and do everything reasonably possible to find the best solution for your celebration.
Depending on the circumstances and with your agreement, this may include:
- Moving your booking to another available date;
- Arranging a suitable professional replacement act; or
- Providing an appropriate refund if no suitable alternative can be agreed.
Any replacement or alternative arrangement will always be discussed with you first. Our priority will be to protect your celebration and reach a fair outcome for everyone.
11. Changes to These Terms and Governing Law
These terms may be updated for future bookings. Any change to a confirmed booking must be agreed in writing by both you and Aurora.
These terms and any dispute arising from them are governed by the law of Scotland.
